Dershowitz based this argument on his interpretation of the 1905 Supreme Court case Jacobson v. Massachusetts, which upheld a state's authority to enforce mandatory smallpox vaccination. He argued that individual rights do not include the right to endanger others by spreading a contagious disease.




MY PERSONAL belief is that you should have a CHOICE, but he was on FIRM LEGAL GROUND to make the claim.
