President Donald Trump and Defense Secretary Pete Hegseth are facing backlash for allegedly threatening the retirement benefits and rank of veterans who speak out against the administration. The conflict centers on Senator and retired Navy Captain Mark Kelly, who is suing the administration for retaliating against him.

The controversy escalated after Senator Kelly made public statements advising service members to follow the law and refuse illegal orders. In response, the administration initiated a military investigation, with Defense Secretary Pete Hegseth attempting to censure Kelly, strip him of his rank, and revoke his military pension. 

In a federal appeals court, lawyers for the Defense Department argued that military retirees remain bound by certain free speech restrictions and that veterans who violate these rules could forfeit their pensions and benefits. Senator Kelly filed a 46-page lawsuit against Hegseth, the Navy Secretary, and the DoD, arguing that the administration is trampling on First Amendment rights and using pension threats to intimidate veterans.

The O.P. is about limiting freedom of speech and somehow that never got discussed.
Kelly will win,plain and simple.
He didn't incite anybody to disobey any orders all he did was repeat what service members are told. "You don't have to obey orders that go against the code of conduct".

I do believe it is petty but military officers who retire after 20 years are still subject to the UCMJ.
