The facts remain Trump was President at the time. As President he had documents with him. He never “hid” these documents and was openly discussing and returned certain documents.

Trump is guilty of malfeasance in the Georgia elections in 2020.
The Trump Organization is guilty of tax evasion in New York.
And then he is also guilty of filching official documents.

Any of these would result in anyone else doing some serious jail time.
