Medical confidentiality laws in all 50 states say an abortion is nobody's **** business besides the woman and her doctor's business.

Maybe I'm wrong about this but I would figure you for a Constitutional originalist.  The founders would be ripping out their wooden teeth over a prohibition to abortion before the quickening.  And they would be having the same reaction to the government interfering in any American's choices about what sort of substances they chose to put in their bodies.

Abortion is a devastating thing for the patient.  I would approve of anything that might give these women a little comfort in such a difficult time.

Pro-life states could simply change their laws and your position is defeated, stewp. And that is only the BEGINNING of what's wrong with your position. Mine is based on the Constitutional RIGHTS of the woman - yours, on extremely theoretical and weak rabbinical legalism and niggling.

You argue incessantly against trusting the several states with citizens' rights - and then rely on just that to justify your agenda.

Within limits. I don't rely on it with regard to regulating air travel or television broadcasts. Consumer protection laws were not necessary at the time the document was put together - but I am not for abandoning those. I'm not sure how the framers might have felt about speed limits, but I know I favor their enforcement.

I don't doubt they would favor choice with regard to pregnancy.

As regards substance use, there is good evidence they'd have favored significant governmental regulation. Their inclusion of eminent domain laws demonstrates their conviction that society qua society has rights and powers above those of the individual. There is also the bit about congress having authority to "raise armies." Anyone who cares a whit for both honesty and context will admit this is a reference in the founding document to the right of society to conscript citizens and force them to fight in wars. That's a pretty extreme curtailment of liberty to serve a public purpose - every bit as extreme as prohibition, and more. 

That said, the notion that they'd have seen any case for prohibition is laughable - and is utterly contrary to the plain language of the Constitution. Regulation? Absolutely. Prohibition? Absolutely not.
