The man has no idea whether something suspicious was going on or not. He's in someone else's yard. And, apparently a neighbor called in a report of a suspicious man in a neighbor's yard. The cop had every right to check this out and ask the man questions.
If Pastor Asshole was actually casing the house looking for an entry point, then a crime was going on. The cop had to evaluate the situation and had the right to do so.
