In an email, an NTSB spokesperson told VERIFY the train involved in the Ohio derailment was not equipped with ECP brakes. On Feb. 16, NTSB chair Jennifer Homendy addressed misinformation spreading about the derailment on Twitter.

 Homendy directly acknowledged that the ECP brake rule would not have prevented the crash if implemented because the train that derailed in East Palestine was a mixed freight train that contained only three placarded Class 3 flammable liquids cars. Homendy said the ECP braking rule would have applied only to high-hazard flammable trains.

No, IDIOT, the RULES didn't meet the REQUIREMENTS of the LAW as passed.....Hence, the RULE WAS NOT REPEALED, it was NEVER IMPLEMENTED!!

The FAST Act included a provision that ordered the Government Accountability Office (GAO) and other researchers to review the ECP brake rule following complaints from railroad companies and lobbyists, including the Association of American Railroads.

 The GAO report found flaws in the DOT’s estimates of potential business benefits of the ECP brakes, including reduced fuel consumption, reduced wear on wheels, and improved operational efficiencies. After the GAO released its findings, the DOT performed a revised cost-benefit analysis, which determined the benefits of ECP brakes did not outweigh the cost of implementing them. On Sept. 25, 2018, the DOT issued a final rule to remove the ECP brake rule from the FAST Act. 

 A few months after the repeal, the Associated Press released a study that found that the DOT’s analysis omitted up to $117 million in estimated future damages from train derailments that could be avoided by using electronic brakes.

 As a result of the AP study, the DOT issued a technical correction in January 2019 but maintained the costs exceeded the benefits of the ECP brake rule, according to the Harvard University Environmental & Energy Law Program.

Ohio's governor, Mike DeWine, also says he requested disaster assistance from FEMA, which he says was denied. But the White House says that's because this is not like a hurricane, tornado or another natural disaster where there's widespread property damage. Also, there is a party that is responsible, Norfolk Southern Railroad (ph), that has promised cleanup funding and other aid. Federal authorities say that FEMA has been in regular communication with state and local officials as have a host of other federal agencies. And state officials do confirm that.

You have to be one stupid son of a bitch to swallow those talking points. Congress does not write regulatons. Regulatory bodies do. Congress OVERSEES those bodies - but it doesn't sign their homework, you uneducated ****. 

Take a civics class. Agencies create regulations under the AUTHORITY of the Congress. The DOT creates the regulations it enforces - and its department head answers to the president who appointed zim/zer, and at who pleasure they/them serves.

I bitch slapped him massively with the FACTS regarding the LAWS that Congress passed that require GAO review of the costs vs the benefits. Benefits of the "rule" did not help one iota with the problems and therefore the costs exceeded any cost benefit out there. THAT was in the Obama Law, not Trump's. AND that train would NOT have been required to be equipped with the EBS since it only had 3 cars of "chemicals' and the rule required I believe 50 or more.

Well, the cost of not having modern braking probably will be justified by not having to pay for more derailments. They were probably counting on just replacing wheel bearings every so often, after they had already caught fire.
