charlie manson was convicted of first degree murder even though he was not there, he was convicted of ordering the others to kill.

He didn't pay his followers to kill anyone. Without the pay element involved he may have been unconstitutionally charged. The notion speech without compensation can compel or control others is a slippery slope that ends with censorship of art and media. Also removes agency and accountability from those that actually committed the crimes. The devil made me do it has never been a successful defense.
