More than just ‘January 6' 

This week it became clear that Donald Trump is likely facing another federal indictment. While the timing of the indictment rests with special counsel Jack Smith, there is one thing we can all do while we wait: Stop calling it "the January 6 investigation."

Horrific as that day was, this case is about more than just Trump’s role in fomenting an insurrection.  

Trump engaged in a sprawling and systematic effort to steal the 2020 election. We have heard and seen evidence that these efforts included defrauding the American public, subverting democratic institutions and coordinating a pressure campaign at the local, state and federal level to overturn the will of the people.

Trump and his allies attempted to compromise and co-opt the Justice Department for political purposes. They submitted fake elector slates, recruiting and directing Trump supporters to forge paperwork and falsify information. 

They created a massive and allegedly fraudulent fundraising campaign to solicit donations based upon a lie. And finally, many of them, including Trump himself, stood idly by as a mob desecrated the Capitol and threatened to hang America’s vice president. 

The attack on our nation’s capitol on Jan. 6, 2021, was one of the darkest moments in our nation’s history, but Trump’s efforts to steal the 2020 election were far more expansive. And as we reflect on how to prevent history from repeating itself, we need to talk about the totality of his actions.

Yes but Pence and Biden did not flip the government the bird nor has there been any evidence they were sharing  information with others nor have they been threatening investigating officials, defaming their characters, nor have they been pretending they are fascist dictators who can do anything they want no matter what.

Rump had the opportunity to cooperate on many things HOWEVER the insurrection activities deserve jail time for all who have been active insiders elected officials or not.

What is the federal crime of insurrection?

It says that “whoever incites, sets on foot, assists or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto” is guilty of that offense. Its penalty is up to 10 years in prison and disqualification from holding federal office.

“sedition” centers more on plotting and incitement, whereas “insurrection” is generally understood to mean the actual violent acts of an uprising aimed at overthrowing the government. That said, the federal law against insurrection, Section 2383, slightly blurs that line.
