By the way, this has happened before, in Florida in 1990:

INDIAN RIVER COUNTY

A former Florida Highway Patrol trooper judged guilty of murdering a female motorist along Interstate 95 in 1990 says he should be eligible for consideration for parole from state prison in the next few years, according to court documents.

"The Department of Corrections records are incorrect (in saying the life sentence is for the duration of [my] natural life)," former trooper Timothy Harris, 54, wrote in his motion filed in Indian River Circuit Court.

In September 1990, Harris was sentenced in Vero Beach to life in prison after he pleaded guilty to first-degree murder of Jacksonville resident Lorraine Hendricks in a heavily wooded area in the median of I-95 in northern Indian River County.

Harris' handwritten motion asks the Indian River Circuit Court to decide whether he should be eligible for a parole review after he serves 25 years in prison. He's been in prison for about 21 years.

Circuit Judge Robert Pegg plans to rule on Harris' motion after getting the State Attorney's response to Harris' claim. Assistant State Attorney Nikki Robinson said she isn't ready to comment. She plans to file her response within the next few weeks.

Pegg has set a deadline for mid-May for getting written opinions.

Around midday March 4, 1990, Harris, who was then 32, stopped Hendricks, 43, for wearing headphones while driving south to a dental appointment in Broward County.

Earlier in her life she had been a model for the FHP's Arrive Alive publicity campaign.

It wasn't until days later searchers found her decomposed body under a brush pile ? meanwhile Harris continued patrolling that area of I-95. The eight-year FHP veteran even stopped along the highway and talked to searchers.

The search started after her car with all her possessions inside ? except for her driver's license and car registration ? were found abandoned along the roadway.

Initially, investigators did not investigate law officers patrolling the area, as they had tips that there were various vehicles ? but not a patrol car ? seen near the crime scene. As other leads didn't produce any suspects, investigators began questioning Harris at length.

Now the former Sebastian Police officer contends the state Department of Corrections is misinterpreting his court sentence. Court records show the sentence is for life. There is a notation his minimum mandatory sentence is 25 years.
