The woman's plight is real. But, the Democrats were quick to jump on this and make political hay out of it. She could have just gone to another state and have gotten the abortion. Instead, Democrats funded an attorney for her, one that she did not actually have to pay 1) bring the lawsuit; 2) bring the appeal and 3) take it to the Texas Supreme Court. The Texas law banning most abortions after about six weeks of pregnacy (S.B. 8) deputizes private citizens to enforce the law. Under the law, individuals may sue those involved in performing illegal abortions and can recieve $10,000 and legal fees if the suit is successful. Some have compared this system to whistleblower reward laws which offer monetary awards to individuals who expose misconduct in areas such as government contracting and securities fraud. However, the Texas law is not a whistleblower law. It operates under entirely separate principles from whistleblower laws and is at odds with the American legal system.
The principal difference between the Texas law and whistleblower laws is that whistleblower laws tie the whistleblower directly with the federal government. In the end, it is the government which is tasked with enforcing the law. In contrast, the Texas law explicitly removes government agencies from the law and thus fosters vigilantism.
How does the Texas Law Compare to the Dodd-Frank Act?
Under the Dodd-Frank Act, the law which established the SEC and CFTC whistleblower programs, a whistleblower turns over their evidence to the appropriate agency. It is then up to the agency to prosecute. If a whistleblower’s disclosure leads to a successful enforcement action, then they are entitled to a monetary award based on sanctions collected in the case. The bounty system set up by the Texas law in no way resembles the whistleblower system established under Dodd-Frank.
