He stood trial for inciting the insurrection and was found not guilty, gonna be a little hard to keep him off the ballot for a crime he was acquitted for. You'll be disappointed again with the next couple of weeks. Reliably conservative justice Neil Gorsuch has the 10th circuit. Too bad, so sad.

The Fedrealist Society has taken a position on the issue of Grifty's eligibility.

It is consistent with the recent decision of the Colorado Supreme Court.

Actually the constitution says nothing about being convicted of it.

If you have no court case for insurrection, then you have no way of demonstrating there even was an insurrection - much less that any particular individual took part in it or incited it. You can't invoke articles of the constitution against someone when you have nothing to base it on, but partisan feelings of pure animus. It amounts to randomly slinging someone off the ballot - against the wishes of 50% of the electorate.

If the required evidentiary standard of the event itself - and participation in it - is zero, presumably we can sling everyone off the ballot for inciting an insurrection - using precisely the same article
