What russian soldiers think and what our legal status is are two different things.

I have been non-stop in my support of Putin and Russia. If we were at war with Russia, I would be risking a charge of treason, were I to continue that.

Correct. 

And the technicality is very important. 

Americans could have volunteered to fight for the Germans without risking a charge of treason, for example.
