The part Ornato told her IS hearsay.  For that part not to be hearsay it would need to have been told to her by the driver...not the driver telling someone who then told her.

Hearsay is an out-of-court statement offered to prove the truth of whatever it asserts, which is then offered in evidence to prove the truth of the matter. The problem with hearsay is that when the person being quoted is not present, it becomes impossible to establish credibility. 

The statement to Bimbo Hutchinson and her statement to the PPC were both out-of-court statements offered as proof of an assertion and it is impossible to prove credibility.  Therefore, it is hearsay and not admissible in a court of law.
