There was no "slapping"....Colorado was working with Section 3 as understood, not as rewritten.ConsRule » 04 Mar 2024, 4:19 pm » wrote: ↑ @R.Suave must write for Slate. They are trying to spin a 9-0 slapping of CO into a 5-4 controversial ruling. All nine justices ruled states, not just CO, could not remove a candidate for a federal position from their ballot using the 14th (basically just Presidential candidates). That action could only be done at the federal level. The reason for multiple opinions is the reason(s) the justices used as a basis for their decision, but they all agrees states don't have the authority.

The disagreement over Congress' role is not trivial, nor confined to the liberal wing.

if the appeals court were to rule in Trump’s favor, it would have no effect on his disqualification, as the constitutional bar is not based on any conviction for any criminal offense. Although insurrection is indeed a federal crime under 18 US Code § 2383, it became one only in 1948, and it is in any case irrelevant to disqualification under the Constitution. None of the ex-Confederates excluded from office after the amendment went into effect were prosecuted for insurrection.

SCOTUS didn't "rewrite" a damn thing. They interpreted the Constitution as written. Read Section 5 of the amendment...it was mentioned in the ruling. Even the liberal justices ruled states don't have the authority. They had different opinions as to why, but they agreed they don't have the authority. Your not wanting to admit that doesn't change the facts.
that says it all, IMO.IMO.
