Kyle was already dead when the original verdict got tossed if I'm not mistaken but Jesse couldn't let it go so he went after the publisher after the fact, since suing a dead man's wife wasn't a good look for The Body.
From what I remember reading, there were just as many people in the bar that night that said it did happen, as said it didn't. I also recall that everyone there that night was pretty loaded too... including Jesse and Chris.
