The New York case was not a federal crime. It was tried by the Manhattan District Attorney, not the US Attorney.
And the statute of limitations was extended because the underlying crime that the record falsification was designed to cover was ongoing.

As I understand it, the FEC crime did not need to be specifically proven... there were four possible crimes that the jury had to choose from and they didn't even need to all choose the same one. Don't like it?
