CNN — Judge Juan Merchan, the judge overseeing Donald Trump’s criminal case in New York, donated $35 in political contributions to Democrats in 2020, including a $15 contribution to the campaign of Trump’s opponent, President Joe Biden.The political donations are undoubtedly small, but they nevertheless raise questions about Merchan’s impartiality as he has come under attack by the former president as a “Trump-hating judge.”

While the government will be able to clear Cannon’s procedural formality, the bigger question will be how she receives the substance of the presumably forthcoming motion. Given her handling of the case thus far and the tone of her latest order, Smith may have a tough task with this judge yet again, one that could finally lead to the special counsel taking Cannon up on appeal and possibly building a case to try and get a new judge to preside.

In August 2022, Cannon was randomly assigned as the judge in Trump v. United States, a civil suit filed by Trump after a search warrant was executed and documents were seized from his Mar-a-Lago property. Trump requested that the court appoint a special master to review the seized materials and temporarily pause the Department of Justice investigation, and Cannon granted the request on legal rationale that many found highly questionable, and which the Eleventh Circuit later roundly rejected. The Department of Justice then requested that Cannon partially stay her order while they appealed it to the Eleventh Circuit, a request that she denied a few days later. Two weeks later, a panel of three judges on the Eleventh Circuit, two of whom were also nominated by President Trump, granted the emergency stay and ruled that Cannon not only abused her discretion in denying the stay but also incorrectly interpreted an “indispensable factor” such that she wrongly decided to exercise equitable jurisdiction over the case. Later, the Eleventh Circuit panel fully overturned her decision and ruled that the district court did not have the jurisdiction to consider Trump’s request, writing:
