I'm sure that she will be just as fair, if not more, than Merchan was.  

According to the Special Counsel regulations, one of the requirements is "The Special Counsel shall be selected from outside the United States Government." Smith has a long history of working in the government. The question of what constitutes "outside the United States Government" has never been answered. Does the regulation mean they shall have never served in an appointment government office that requires Senate confirmation, or does it mean not currently working in the US government.

There is no harm in clarifying that point. Unless of course, the prospect of getting an answer scares you.

Merchan donated to Biden's campaign in 2020 and Merchan's daughter worked on the 2020 Biden/Harris campaign... and Engoron is a New York leftist that was caught discussing the Trump case outside of chambers with an attorney not involved in the case that had previously gone after Trump in separate case years earlier... and of course nothing was done about either.
