Yes I have.  You asked if someone should face consequences.  While I asked what the consequences were, I did post what the judge's options were.  Since I am not an expert of NY state sentencing guidelines, I posted a link and a comment about those options.

Just because you don't like an answer, doesn't mean the question wasn't answered.
