The second post of mine that generated line 3 above was that Kaplan chose to focus on an accusation the trial jury found did not happen rather than one they found did happen. His filing was the ruling denying the appeal of the size of the award. There are many examples of sexual assault, other than simple groping, he could have used to justify the size. He CHOSE to redifine the NY Penal Law definition of rape to fit...in my opinion...his agenda rather that simply use existing law. You will have to ask Kaplan why he chose that route.
My post that generated your third comment (These?) is related to the one above. Since there was no award related to the accusation of rape, that is even more reason for Kaplan to focus on the part of the verdict and award that was relevant and not things that, according to the trial jury, did not happen.
My post that "Why Kaplan filed is not relevant to our topic." and "The opinion of the judge is irrelevant when you have the actual jury verdict at your disposal." are correct because the point I was making was the jury verdict...and we have their actual verdict form. Since the filing Kaplan made (that you love quoting snippets from) was NOT a filing on the accusations made by Carroll but rather a ruling on the award appeal. It does not change the finding of fact made by the jury...no matter how much you and (apparently) Kaplan want.
The last comment was made after you first pointed to Kaplan using a definition of rape other than NY Law. You did so in a new article. It wasn't till later that you provided a link to the actual filing.
