Release Date: April 14, 2025Washington, D.C.— Today, Department of Homeland Security (DHS) Secretary Kristi Noem set the record straight about Kilmar Abrego Garcia in light of misleading mainstream media reports.“This was just one of those examples of an individual that is a MS-13 gang member, multiple charges and encounters with the individuals here, trafficking in his background, was found with other MS-13 gang members—very dangerous person, and what the liberal left and fake news are doing to turn him into a media darling is sickening,” said Secretary Noem.
White House Deputy Chief of Staff Stephen Miller also highlighted the President’s authority to deport Abrego Garcia today from the Oval Office. “The Supreme Court said the district court order was unlawful and its main components were unlawful and reversed 9-0 unanimously, stating clearly that neither the Secretary of State or President could be compelled by anybody to forcibly retrieve a citizen of El Salvador from El Salvador who, again, is a member of MS-13,[.b] which—as I’m sure you understand—rapes little girls, murders women, murders children, is engaged in barbaric activities in the world. And I can promise you if he was your neighbor, you would move right away.”

In addition, DHS Assistant Secretary Tricia Mclaughlin reaffirmed that this MS-13 terrorist gang member is where he belongs.“I think this illegal alien is exactly where he belongs—home in El Salvador. He was in our country illegally, he is from El Salvador, was born in El Salvador, and, oh, the media forgot to mention: He is a MS-13 gang member. The media would love for you to believe that this is a media darling, that he is just a Maryland father. Osama Bin Laden was also a father, and yet, he was not a good guy, and they actually are both terrorists. He should be in this El Salvador prison, a prison for terrorists, and I hope he will remain there.”

NOEM v. ABREGO GARCIA

Because every factor governing requests for equitable relief manifestly weighs against the Government, Nken v. Holder, 556 U. S. 418, 426 (2009), I would have declined to intervene in this litigation and denied the application in full. Nevertheless, I agree with the Court’s order that the proper remedy is to provide Abrego Garcia with all the process to which he would have been entitled had he not been unlawfully removed to El Salvador. That means the Government must comply with its obligation to provide Abrego Garcia with “due process of law,” including notice and an opportunity to be heard, in any future proceedings. Reno v. Flores, 507 U. S. 292, 306 (1993). It must also comply with  Statement of SOTOMAYOR, J. its obligations under the Convention Against Torture. See Convention Against Torture and Other Cruel and Inhuman or Degrading Treatment or Punishment, Dec. 10, 1984, S. Treaty Doc. No. 100–20, 1465 U. N. T. S. 113. Federal law governing detention and removal of immigrants continues, of course, to be binding as well. See 8 U. S. C. §1226(a) (requiring a warrant before a noncitizen “may be arrested and detained pending a decision” on removal); 8 CFR §287.8(c)(2)(ii) (2024) (requiring same); see also 8 CFR §241.4(l) (in order to revoke conditional release, the Government must provide adequate notice and “promptly” arrange an “initial informal interview . . . to afford the alien an opportunity to respond to the reasons for the revocation stated in the notification”). Moreover, it has been the Government’s own well-established policy to “facilitate [an] alien’s return to the United States if . . . the alien’s presence is necessary for continued administrative removal proceedings” in cases where a noncitizen has been removed pending immigration proceedings. See U. S. Immigration and Customs Enforcement, Directive 11061.1, Facilitating the Return to the United States of Certain Lawfully Removed Aliens, §2 (Feb. 24, 2012). In the proceedings on remand, the District Court should continue to ensure that the Government lives up to its obligations to follow the law.

But the Supreme Court decision, by upholding Xinis’ authority to direct the government to facilitate Abrego Garcia’s return, is a rebuke to the administration, which, since the return of President Donald Trump to the White House, has made the forcible deportation of purported gang members a top priority.

a  lie from a new jew order cocksucker you.

--------------------------------------------------------Attorneys for a Maryland man mistakenly deported to a Salvadoran prison said the Trump administration has run afoul of a Supreme Court order by failing to even attempt to secure his return. The Supreme Court last week determined the Trump administration must “facilitate” the return of Kilmar Abrego Garcia, a Salvadoran national now held in the country’s most notorious prison. But attorneys for Abrego Garcia contend the Trump administration has not even tried to do so.
