  • A service member is legally obligated to refuse orders that are "manifestly illegal," or orders that are clearly and obviously against the law.
  • Examples include orders to target civilians, commit torture, or falsify documents.
  • The military oath is to the Constitution, not to any individual, so service members are required to follow orders that align with the Constitution and law.
  • Following an unlawful order does not excuse the individual from responsibility; the "Nuremberg defense" is not valid in this context.
