The Supreme Court ruled in the 1963 case Bantam Books v. Sullivan that the government cannot make threats that influence speech and has upheld that decision in subsequent rulings

Legality of Attacking Survivors
Under the Geneva Conventions and established principles of international humanitarian law:

• Persons who are "hors de combat" (out of combat, incapacitated, or shipwrecked) must be respected and protected in all circumstances.
• Targeting survivors is strictly prohibited, whether in an officially declared armed conflict or not. If the U.S. is not in an armed conflict, such a killing would be considered murder or an extrajudicial killing under international human rights law.
• The U.S. military's Law of War Manual (2023) uses attacking shipwrecked enemies as a paradigmatic example of an illegal act.
