The concept of escalation is a factor. Also subjective.

But if the needle on the "Who Started It Meter" means anything,
the judge usually sides with the cops for good reason: It is a WHO STARTED IT METER.

Cops aren't called to picnics. Something is already going on by the time they get there.
I am not saying they don't **** up but in an escalating situation the "excessive force whine" is overused.

btw Being arrested doesn't mean you've done anything wrong.
Flipping out while being cuffed is merely an ignorant asshole putting charges on his docket.
