- Yes! All members of the military have the right, and in some cases have the duty, to refuse illegal orders. The Department of Defense (DoD) Law of War Manual explicitly states that killing shipwrecked or otherwise incapacitated survivors who are "out of the fight" (hors de combat) is a war crime and strictly prohibited. Orders to do so are illegal and must be disobeyed by service members.
