Fifth columnists within government abusing their position does not exonerate the criminals that fifth columnist assists. 

Any of the invaders could certainly make an ARGUMENT that their being allowed in absolves them as individuals. But the fact that a number of highly placed fifth columnists broke the law to assist the invaders cannot be used to argue an invasion has not taken place. Indeed, identifying those criminals rather serves the opposite function.
