Kennedy Center tarp to stay up indefinitely, lawyers say

A Democratic lawmaker is asking a judge to halt a renewed plan to recognize President Donald Trump on the building and to demand a better explanation for the tarped facade.

The center’s explanation for the tarp’s persistence came Tuesday night in its update to Cooper. Matt Floca, the center’s executive director, said in a sworn statement that the tarp served as a “necessary safety barrier” to protect workers and the marble facade. A team of Justice Department lawyers led by Assistant Attorney General Brett Shumate said in their update to Cooper that the scaffolding and its “protective covering” are still needed for the upcoming renovation and offered no estimate of when the tarp might come down.

Beatty’s lawyers were unpersuaded. The center said it needs the scaffolding to inspect the roof overhang, they noted, but the soffits sit some 20 feet above it. The center implied more scaffolding is coming to examine the rest of the roof, they wrote, but none has gone up in months, leaving only the center’s name obscured. Courts are “not required to exhibit a naiveté from which ordinary citizens are free,” they wrote, quoting an older court case.
