Ordering Non-Essential Businesses to Close is Unconstitutional and Unenforceable

Sec. 1 of the 14th Amendment reads as follows:
No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property without due process of law, nor deny to any person within it's jurisdiction the equal protection of the laws.


States are right now, via Governor order, offering protection to some citizens, who own, operate, or work at 'essential' businesses, while denying it to other citizens, who own, operate, or work at 'nonessential' businesses. By the Equal Protection Clause of the 14th Amendment to the United States Constitution, this is completely and totally illegal. States may not do this. Only the Federal government can do it. A state governor has no Constitutional authority to selectively shut down businesses. Any business which has lost any money over this action in any state should give consideration to suing the Governor for the breach of their Constitutional rights.

The argument about pandemics is hollow. The founding fathers were familiar with pandemics. Yellow fever killed 5,000 and displaced 17,000 of a total 28,000 people in Philadelphia in 1793. The Bill of Rights became effective two years prior. Everyone who passed it was still alive. Nobody changed it to add a Pandemic Exception.


1st Amendment
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

They left it just like this, even after seeing most of Philadelphia either die or leave town.
So genius, you think all these thousands of businesses that have closed down for good and lost ever dime they ever invested won't pursue legal channels against the state?  How do you think a moron like Cuomo is going to be able to justify the closure of a business when they can point to such a miniscule number of people who contracted the virus at their establishment, when it would be virtually impossible to prove otherwise? 
I'm currently working with the owners of two fitness centers in Staten Island, NY.  One was permitted to reopen a few months ago, and the second one was ordered to remain closed because it fell within an arbitrary parameter chosen by Cuomo, despite being less than half a mile from the first one.

Bottom line, if you don't like what's contained in the US Constitution, THEN GO THROUGH THE PROCESS OF CHANGING IT!  Otherwise, shut the **** up when it comes to yapping about something you're clearly so ill-informed about!
