You people defending him should take a self defense class or two.
You're saying I would be in my right to whip my gun out and shoot someone that says something I feel is a threat. There has to be imminent danger. And that still might not be enough if I can't prove there was.
And Penny wasn't in any immediate danger. He was behind the guy and snuck up on him like a little bitch. What a Marine!. And then administered vigilante justice.
