Depends? Where (what jurisdiction) did it happen? What do the laws of that jurisdiction (at the time of the incident) state as the elements of rape? Those questions need to be answered before your question can be answered. However, in the case for which I provided the jury verdict form...those questions ARE answered. And the jury rendered their verdict in accordance to the law. So, do you accept their verdict?
