It's very easy to "distribute" a talking-to punishment. The other, not so easy.
So, yes, it's about the punishment.

So, far you have defended maiming/crippling a person.
Now you say the punishment is merely an afterthought.

Perhaps it's easier to distribute a "talking to" punishment. Which one will suffice though? Say a kid steals a piece of candy. You find out as a parent. What is the form of justice you would prefer? Would a talking to be more effective or the other? Would you distribute punishment just for your child to return the candy and apologize? That would be restitution. The best theory in my view would be to raise the child to not steal to begin with. That's probably why there are laws. The act of stealing is met with some sort of known punishment that deters the action. 
Nothing is easier than defending the status quo.
