Mr. Neely had been arrested over 30 times for assaulting people in the subways and had attempted to throw several in front of on coming trains in the past. He apparently, according to witnesses in the subway car at the time, had started acting extremely radically and was threatening to murder several of the passengers. An unnamed 24 year old white Marine and another unnamed black man grabbed Mr Neely and put him in a "suppression hold", not a choke hold. As soon as Mr. Neely, according to several witnesses became subdued the hold was released but died anyway.
The police were no where to be found and the passengers felt threatened by Mr. Neeleys action. But in New York City self defense against a black perpetrator is automatically an act of racial violence against a black man and the unnamed Marine should be given the death penalty.
