I understand what you were getting at earlier (about people going after Jones while proclaiming to be LIBRULZ) is laughable but I don't see how there can ever truly be a system that protects that you call "legitimate free speech." The table is always rigged in one way or another...and in some cases (such as today) it's heavily rigged.
The closest we've gotten to parity among all parties was probably back in ~1800 (when the US was still a nascent limited republic) and even then we ran into issues like sedition, arresting war protestors, etc.
