Medicaid Asset Recovery (MAR) 

If you don't die "suddenly and unexpectedly", MAR will take every penny the "health system" missed before you died. Trusts are little defense against MAR. 

You can thank a Lutheran Senator from Minnesota for giving us MAR in the 90s.

I was the recipient of a headache. My dad died without a will. I found evidence of 2 separate wills. Neither were ever filed.  I showed up one morning to take him to his doctor's appointentment and found him dead on his couch. I could not find his will anywhere. I secured what I could.

Pretty soon I had relatives showing up like vultures to strip away his meager possessions. I put a quick stop to that. I locked down his bank account, cancelled his credit cards, etc. I knew this was going to probate. Nightmare.

They're all vultures already circling waiting for me to die. They're all penniless and perpetually in trouble with the law. 

When they inherit they'll bicker about it and much like lottery winners they'll be broke in less than a year. Why should I try and make their lives 'eaiser?' I've told them what they need to do and they don't listen.

Be sure to detail who gets what. I have seen so many kids fighting over their parent's house when the last parents writes, "I leave the house to all my children." 

The parent might love all the children, but they definitely do NOT like each other and will sue each other over who gets the house --- lives in it, pays the ills, etc.  


Yes. And what often happens in reality is relatives (and others) swoop in and just start taking things left and right.

It’s impossible to prove later that any of the items were stolen (which they were). I have several friends this happened to. They ended up spending hundreds of thousands pursuing things taken from the estate. LEO and the courts were absolutely useless. An itemized will is a good vehicle but it doesn’t prevent the thieves from doing their work
