In the State of NY, I don't believe he is considered a felon in the eyes of the law until he is sentenced... which hasn't happened yet.
I may be mistaken, but I recall reading that somewhere.
Also, if the convictions are tossed on appeal, which they very well could be, then the "felon" moniker goes away as well.
