Prosecutions for the mishandling of national defense information documents are not based on the PRA, they are based on the Espionage Act. Fact is that he had records in clear violation of the PRA, regardless of what was on them.
Given that Senators and members of the exec branch routinely remove classified docs and take them home, (with the expectation of returning them) the DOJ policy is to give them the benefit of the doubt if they are discovered later and not returned, that they were inadvertently acquired. All that occurs as that juncture is that the person cooperate fully in the return of the documents.
That was the case with Biden and Pence, but is not the case with Trump.
