Yes, the evidence is pointing to the fact that Trump will soon be indicted for obstruction related to holding TS/SCI docs and criminally obstructing the government's efforts to retrieve the documents, whereas Pence and Biden are cooperating fully. And no, the DOJ's policy is not to prosecute for mere possession, as long as it was done inadvertently, and there is a complete willingness to return all the documents, regardless of their classification. The DOJ's policy, it seems, is requiring aggravated circumstances, such as obstruction, witness intimidation, declaring on TV one has the right to take them, and make lies about them, etc. This is, indeed, the case with Trump but not with Biden or Pence.
