Fact is, YOU HAVE TO PROVE that he DID NOT declassify in order to have a criminal case. PERIOD!! THE ONUS is always to PROVEN BEYOND A REASONABLE DOUBT of guilt!!
See above.The simple FACT that the President has UNLIMITED declassification power as the Commander and Chief of the military ends ALL requirements to do ANYTHING other than say "Its declassified" and even then, he doesn't even have to do that.
