And since there is a LAW regarding insurrection, you MUST be convicted of it since the 14th Amendment ALSO gave Congress that authority to pass such a law. See US Code. 18 U.S. Code § 2383 - Rebellion or insurrection
Nothing in the 14th says you have to be convicted of it.
