NO ONE has to pay that - EVER. Every person in America has a choice to not pay that fine. Those who DO pay it, CHOOSE it. They see it as an alternative minimum tax to the tax that is obamacare.
If you CHOOSE the negative consequence - like, say, paying taxes on your retirement accounts for not investing them wall street, or not getting the job you want because you refuse to join the union - then it's a choice you made. No one forced you.
