Which has nothing to do with it. The Constitution doesn't say anywhere that courts can re-draw districts on that basis; only that legislatures do so.

The Republican Assembly's map was in violation of PA's Constitution.
The court gave them a chance to fix it.
They refused and chose to fight it out in court.
They lost.
