No, the Justice Dept. is supposed to apply the law AND the Constitution. At least one court has already declared Obamacare to be unconstitutional, and Trump's attorneys are following that they believe to be the Constitution.

If they believe Obamacare as it is today is unconstitutional, they are obligated to petition SCOTUS as such.

That's their job.

He's trying to take away healthcare from 20 million people with nothing to put in it's place.

He has to pay for his stupid tax cuts for the rich which are driving up the deficit, and he's going to do it by literally killing people.
