The only way to be charged with desertion is to be AWOL for 30 days or more. AWOL is charge under the UCMJ. (Google it). The UCMJ is federal code. In order to be charged under the UCMJ you have to be either active duty or FEDERALIZED.
So no, no AWOL means no Desertion. Just for the record Kerry himself requested early discharge as did Bush.
