1.  FACT. ATF classifies the M 16, or any automatic weapon, as a machine-gun.  Please stipulate to that.

2.  FACT. ATF did not classify the Sporter a machine-gun because the design was changed.

3.  FACT.  The government has classified any automatic weapon as a machinegun no what iteration of the NFA we are under at the time.  Whether 1034, 1968, 1986, etc it is still machine-gun.
