- In 2019, Kilmar Abrego Garcia was arrested outside a Home Depot in Hyattsville, Maryland, and detained by Immigration and Customs Enforcement (ICE). During this period, he had several immigration hearings:
- Bond Hearing: An immigration judge, Elizabeth Kessler, denied his release on bond, citing evidence presented by ICE that he was a "verified member of MS-13," based on a Gang Field Interview Sheet (GFIS) and a Form I-213. However, the judge noted inconsistencies in the documents, and Garcia's attorneys disputed the gang affiliation, stating he had no criminal record.
- Withholding of Removal Hearing: After a lengthy hearing where Garcia provided credible testimony, an immigration judge granted him "withholding of removal" status in 2019. This legal protection prohibited his deportation to El Salvador due to a well-founded fear of persecution by local gangs. His asylum application was denied because he applied too late.
He had three immigration hearings during this period: one establishing an alleged MS-13 affiliation, another upholding it, and a third denying his asylum and Convention Against Torture (CAT) claims while subjecting him to deportation (though the withholding of removal protected him from deportation to El Salvador).
