Birthright citizenship in the United States was primarily created to ensure that formerly enslaved African Americans and their descendants were recognized as full citizens following the Civil War. It was formally established through the 14th Amendment in 1868 to overturn the Supreme Court's 1857 Dred Scott v. Sandford decision, which had ruled that Black people could not be U.S. citizens.
