But APPEALS can be based on ANY NUMBER of things in a trial and this "rejection to hear" is but ONE instance that has NOT been fully settled UNTIL the SCOTUS ACTUALLY MAKES A RULING!! PERIOD!!
YOU might think it is, but you can bet, lawyers are working on other avenues RIGHT THIS MOMENT!!
