Because you have never read the amendment, you glom onto the part your attention is directed to. The FULL text has an important conjunction: the word "and." It goes like this: AND SUBJECT TO THE JURISDICTION THEREOF.
Americans are subject to the jurisdiction of the united states. If you go to thailand to sex up 15 year olds, your actions may be perfectly legal THERE. But because you are an american, you are subjection to the laws HERE. And you can be prosecuted HERE for what you did over THERE.
The nigerians were subject to the jurisdiction of NIGERIA - and so was their baby, being nigerian. It is an offense to botht the plain language of the amendment and the contempoanously statedintent of the amendment to treat the amendment as if only the first clause exists.
