the law specifically deals with people who, PRIOR to the passage of the law (HERETOFORE), had been involved in an insurrection.  By using that word, it clearly and unambiguously does NOT apply to those folks who may participate in an insurrection at some point in the future.

The real amusing part is that you can't admit that the word was chosen for the precise reason I laid out - to absolve past insurrectionists of their crimes and to allow them to reenter the process of governance.  If Congress had wanted to say that any future insurrectionists would have their preemptive approval and encouragement,  they could have simply started the process to repeal the entire amendment or, at least, section 3, which they did not.  In fact, they were quite able to absolve crimes of the past while retaining the admonitions against insurrections going forward simply by inserting that one word.  "Heretofore" is a very cool word, imho.  It says so much with just ten little letters!

When intellectual relative time logistics isn't the same thing as biological relative time adapting as displaced "heretofore" is hyperbole.

Section 3 does not specifically refer to the presidency, as it does members of the U.S. Senate or House of Representatives. Instead, the clause refers to “elector of President and Vice President,” along with civil and military offices.
