I didn't say intent doesn't matter. I said people are charged with their actions, not their intent. Intent is ultimately unknowable as it's part of a person's internal thought processes. Progressives certainly are moving towards punishing thought crimes but fortunately we are not there yet.

Intent is a element of many crimes and is used in law all kinds of law

Point stands. You cannot be charged with intent to overthrow the government unless you have the means to make a credible attempt.
